Legal Notices – ANOMIS® Immobilien

The brokerage agreement with our agency or its representatives is established through the use of our real estate brokerage services. The commission payable by the buyer amounts to 6% of the purchase price plus statutory VAT.
If a purchase contract is concluded through the activities of ANOMIS® Immobilien, the undersigned agrees to pay a commission of up to 6% of the originally offered purchase price, regardless of the final negotiated price. The minimum commission is €3,000 plus VAT.
The commission becomes due upon signing the preliminary purchase agreement or at the latest upon notarisation of the purchase contract. Multiple clients are jointly and severally liable. Upon signing a preliminary contract, an immediate payment claim arises.
All information is provided without guarantee. Prior knowledge of an offered property must be communicated in writing. In addition, our General Terms and Conditions apply.
The General Terms and Conditions form an integral part of the brokerage agreement and are hereby accepted by the client. Clients may be consumers or businesses.

General Terms and Conditions (GTC) of ANOMIS® Immobilien

The following General Terms and Conditions form the basis of the brokerage agreement. The client confirms that these GTC have been included in the agreement and acknowledges having received a copy or having been informed of the possibility to view them at www.anomis-immo.de/agb.

1. Scope

A brokerage agreement arises through the use of our services with knowledge of the commission due in the event of purchase, or by written agreement in the event of intended purchase.

Right of withdrawal: within 14 days, the client may withdraw from the contract with ANOMIS® Immobilien in writing, without stating reasons.

2. Confidentiality / Prohibition of disclosure

All offers and information provided by ANOMIS® Immobilien, including exposés and their contents, are confidential and intended solely for the recipient. Disclosure to third parties without prior written consent is prohibited.

If the client violates this obligation and a third party concludes the main contract, the client shall pay damages equal to the commission owed. The client may provide evidence of lesser or no damage.

Further claims for damages remain unaffected.

3. Offers

Offers from ANOMIS® Immobilien are non-binding. Errors, prior sale or rental are reserved.

Information is based on data from sellers/landlords; ANOMIS® Immobilien does not guarantee accuracy.

Verification of property information is the client’s responsibility. Liability is only accepted in cases of intent or gross negligence.

4. Commission entitlement

The disclosure of the property address or seller is made with explicit reference to the commission claim.

The commission is earned once a contract is concluded due to ANOMIS® Immobilien’s brokering or introduction. Causation is sufficient.

Commission is owed even if the contract differs from the originally offered terms, involves another property of the same seller, or is economically equivalent (e.g., purchase instead of rent, purchase of shares, leasehold, exchange).

5. Commission due date

The commission becomes due upon signing the preliminary contract or the final purchase/rental contract.

It is payable upon invoicing.

ANOMIS® Immobilien has the right to be present when the main contract is signed.

If not present, the client must promptly disclose the essential content of the contract.

The commission is owed even if the seller is also a broker.

6. Commission amount

Commission is calculated from the total purchase or rental price.

Unless otherwise agreed:

seller’s commission: 0–3%

buyer’s commission: 3–6%

as specified per property, plus VAT (currently 19%).

Minimum commission: €3,000 plus VAT.

7. Dual agency

ANOMIS® Immobilien may act for both parties and must remain impartial.

8. Prior knowledge

If the client already knows the property, they must notify us within 3 days and provide evidence if requested.

Failure to do so results in reimbursement of expenses.

9. Referral commission

Payable only if:

  • the property is not already known to ANOMIS® Immobilien
  • the property is not publicly listed
  • the property is located in Germany or Italy
  • a written referral agreement exists
  • a valid brokerage contract with commission agreement is signed
  • payment is not made to the referrer’s bank account
  • the referrer is not the owner

10. Limitation of liability

Liability for simple negligence is excluded, except in cases of injury to life, body, or health, or breach of essential duties.

Claims expire after three years.

11. VSBG information

ANOMIS® Immobilien is neither obliged nor willing to participate in consumer arbitration procedures.

12. Place of performance and jurisdiction

For merchants, the place of jurisdiction is Berlin, Germany.

13. Severability clause

If any provision is invalid, the remainder remains effective. The invalid clause shall be replaced with one that best reflects the parties’ economic intentions.
